Terms of Use

Agreement

By downloading or using Simple Poke Scan ("App"), you agree to these Terms of Use. If you do not agree, do not use the App. The App is provided by Tevin Tober, Trachtenweg 5a, 33607 Bielefeld, Germany ("Developer").

License

The Developer grants you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. This licence also covers use by other accounts associated with your purchase via Family Sharing or volume purchasing. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or derive works from the App.

Maintenance & Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required by applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

Premium Subscription

The App offers an optional monthly auto-renewing Premium subscription processed by Apple App Store or Google Play Store. Premium removes Google AdMob banner and video advertisements. eBay affiliate links remain visible to all users regardless of subscription status.

Payment is charged to your App Store or Google Play account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current billing period. The subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your account settings on the respective platform (Apple App Store or Google Play). No partial refunds are issued for unused periods; cancellation takes effect at the end of the paid period. By expressly requesting immediate access to Premium, you acknowledge that your statutory right of withdrawal expires upon commencement of the subscription (where applicable under local law).

There is no free trial. The App is fully and permanently usable for free with advertisements only.

App Content & Updates

The Developer may update the App's card database and features at any time at their sole discretion. Neither free users nor Premium subscribers have any contractual right to receive content updates, new card sets, or feature additions. The Developer makes no commitment regarding the frequency, scope, or timing of future updates.

Advertising

Free users see banner and video advertisements served by Google AdMob. By using the free version you acknowledge that advertising is used to fund the App. You may opt into non-personalized ads via the in-app consent settings.

eBay Affiliate Links

The App displays links to eBay for price comparison. These are affiliate links — if you make a purchase through them, the Developer may receive a commission at no additional cost to you. eBay affiliate links are shown to all users, including Premium subscribers. The Developer is not responsible for eBay's content, pricing, or availability.

Card Price Data

Card price information is fetched from third-party sources (Cardmarket) and is provided for informational purposes only. Prices are estimates and may not reflect current market values. This information does not constitute financial or investment advice. The Developer makes no warranty as to accuracy or completeness.

Pokémon Trademark Notice

Simple Poke Scan is an independent project and is not affiliated with, endorsed, sponsored, or approved by Nintendo, The Pokémon Company, or Game Freak. Pokémon and all related names, characters, and trademarks are the property of their respective owners.

Prohibited Use

You may not use the App to violate any applicable law; transmit harmful, unlawful, or infringing content; attempt to gain unauthorised access to any system; interfere with the App's operation; or use the App for any commercial purpose without prior written consent.

No Warranty

The App is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by applicable law, all implied warranties are disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the Developer's sole responsibility.

Limitation of Liability

To the maximum extent permitted by applicable law, the Developer is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data or profits. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud, or any other liability that cannot be excluded under German law (§ 309 No. 7 BGB).

Termination

The Developer may suspend or terminate your access to the App at any time for breach of these Terms. Upon termination, your licence to use the App ends immediately.

Changes to These Terms

The Developer may update these Terms from time to time. You will be notified of material changes via the App or by email with reasonable notice. The current version is always available at this URL. Continued use after notice of minor changes constitutes acceptance; material changes require your express consent.

Export Compliance

By using the App, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. For consumers within the EU, mandatory consumer protection provisions of your country of residence also apply and are not affected by this choice of law. The UN Convention on Contracts for the International Sale of Goods does not apply.

Third-Party Terms

When using the App and its features, you must comply with all applicable third-party terms of service. For example, when using eBay price comparison links you must not be in violation of eBay's terms of service, and when accessing Cardmarket price data, Cardmarket's terms of use apply.

Platform Notice (Apple App Store & Google Play)

This agreement is concluded solely between you and the Developer; Apple Inc. and Google LLC are not parties to this agreement and bear no responsibility for the App or its content. The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the HealthKit and HomeKit frameworks. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, have the right to enforce them against you.
